The choice made will determine the optimal path for commercialization of this technology. As mentioned previously the PCT has to be filed by June 26, 2013, the one-year anniversary of the PPA filing, to ensure that the patent protection currently in place is maintained. If a PCT is not filed, the scientists and LBNL can choose to either suspend all of their activities or to engage with providers of incumbent or emerging technologies as consultants. In this type of arrangement the scientists would draw from their subject-matter expertise and knowledge of OFC technology to further develop similar or new technologies. Based on limited interest expressed by the scientists and our recognition of the time and resources required to construct this mentioned “open source consulting” arrangement, we advise against this approach. Moreover, we propose that the PCT be filed as doing so will allow for the pursuit of two potential paths to commercialization.
